California has enacted the Responsible Textile Recovery Act of 2024 (SB 707), the US’s first mandatory textile take-back program, aiming to reduce textile waste and promote sustainability.

Key aspects of the law include:
Extended Producer Responsibility (EPR): Producers of apparel and certain textile products are required to implement and fund programs for the collection, recycling, or upcycling of their products, shifting end-of-life management responsibilities from consumers and local governments to the producers themselves.
Implementation Timeline: By January 1, 2026, producers must form a Producer Responsibility Organization (PRO) and join it by July 1, 2026. The PRO is responsible for developing a statewide plan to collect, transport, repair, sort, and recycle post-consumer apparel and textile products by July 1, 2030, or upon plan approval by CalRecycle, whichever is sooner.
Collection Systems: The law mandates the establishment of convenient collection methods, such as drop-off sites and mail-back programs, to facilitate consumer participation in textile recycling.
Performance Standards: Producers, through the PRO, must meet specific recovery rates and adhere to plans for managing chemicals like PFAS to prevent contamination in the recycling process.
Penalties for Non-Compliance: Producers failing to comply with the Act may face administrative civil penalties up to $10,000 per day, or $50,000 per day for intentional or knowing violations.
